Terms & Conditions — PureJoy Foods T/A imPRESSice

1. Introduction
These Terms and Conditions ("Terms") govern your use of the PureJoy Foods T/A imPRESSice website and the purchase of our products. By placing an order or using our website, you agree to be bound by these Terms.
imPRESSice ("we", "us", "our") is registered in South Africa and operates under South African law.
2. Definitions
• "Products" refers to ice lollies and any other food products sold by imPRESSice
• "Customer" or "you" refers to the person placing an order
• "Website" refers to www.impressice.co.za and any related platforms
3. Orders and Acceptance
3.1 When you place an order, you are making an offer to purchase our products.
3.2 We reserve the right to accept or decline any order at our discretion, including (but not limited to) cases of product unavailability, pricing errors, or suspected fraudulent activity.
3.3 Order confirmation will be sent via email once we accept your order. This constitutes a binding contract between you and imPRESSice.
3.4 All orders are subject to product availability.
4. Pricing and Payment
4.1 All prices are displayed in South African Rand (ZAR) and include VAT where applicable.
4.2 We reserve the right to change prices at any time, but changes will not affect orders already confirmed.
4.3 Payment must be made in full at the time of ordering through our secure payment gateway.
4.4 We accept the following payment methods: [credit card, debit card, EFT, Instant EFT]
4.5 In the event of a pricing error, we will contact you to offer the correct price or cancel the order with a full refund.
5. Delivery
5.1 We deliver to addresses within [Cape Town and surrounding areas" and will be expanding "nationwide"].
5.2 Delivery timeframes are estimates only and may vary due to factors beyond our control (weather, courier delays, etc.).
5.3 Our products are perishable and require frozen storage. We use insulated packaging and dry ice/ice packs to maintain temperature during transit.
5.4 Delivery fees are calculated at checkout and vary based on location and order size.
5.5 You must provide a safe and accessible delivery address. We are not responsible for failed deliveries due to incorrect addresses or unavailability to receive the order.
5.6 Risk of loss or damage passes to you upon delivery. Please inspect your order immediately upon receipt.
5.7 If you will not be available to receive a frozen delivery, please arrange for someone to accept it on your behalf or provide special delivery instructions.
6. Product Quality and Perishability
6.1 Our ice lollies are perishable food products that must be kept frozen.
6.2 We guarantee our products are fresh and properly frozen at the time of dispatch.
6.3 Once delivered, it is your responsibility to store products correctly (in a freezer at -18°C or below).
6.4 We cannot be held responsible for products that melt or deteriorate due to:
• Delays in refrigeration after delivery
• Improper storage by the customer
• Extended delivery times caused by incorrect address information
• Force majeure events (power outages, extreme weather, etc.)
7. Allergens and Dietary Information
7.1 We provide allergen and ingredient information for all products on our website and packaging.
7.2 It is your responsibility to review this information before ordering if you have allergies or dietary restrictions.
7.3 While we take precautions, our products may be manufactured in facilities that handle common allergens.
7.4 We are not liable for allergic reactions or adverse effects resulting from consumption of our products.
8. Returns, Refunds, and Cancellations
8.1 Cancellations: Orders may be cancelled free of charge up to 2 hours after placing the order" or "before dispatch"]. After this point, cancellations may not be possible.
8.2 Damaged or Defective Products: If your order arrives damaged, melted (due to our error), or defective, please contact us within 24 hours of delivery with photographic evidence. We will offer a replacement or full refund.
8.3 Change of Mind: Due to the perishable nature of our products, we cannot accept returns or offer refunds for change of mind once an order has been dispatched.
8.4 Incorrect Orders: If we send you the wrong product, please contact us within 24 hours. We will arrange collection (if feasible) and send the correct item or provide a refund.
8.5 All refund requests are subject to verification and approval.
8.6 Approved refunds will be processed within 2 – 5 business days to your original payment method.
9. Consumer Protection Act
9.1 Nothing in these Terms limits your rights under the South African Consumer Protection Act, 68 of 2008 ("CPA").
9.2 You have the right to receive products that are safe, of good quality, and fit for purpose.

10. Limitation of Liability
10.1 To the extent permitted by law, PureJoy Foods T/A imPRESSice will not be liable for:

• Damages exceeding the value of your order
10.2 We are not liable for delays or failures caused by circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, power failures, or pandemics.
10.3 Our total liability to you for any claim arising from your order will not exceed the amount you paid for that order.
11. Intellectual Property
11.1 All content on our website, including text, images, logos, and branding, is the property of imPRESSice and protected by copyright law.
11.2 You may not reproduce, distribute or use our content without written permission.
12. User Conduct
12.1 When using our website, you agree not to:

Our kids relationship towards food is not as simple as good or bad behaviour, as role models we can tread gently and lead by example. One of the most important elements when creating imPRESSice was to create a nutritious offering for children containing no commonly known allergens, and we pulled it off – tasty natural ice lollies!
